Welcome to Car Addicts Cyprus, Cyprus’ first online car auction platform. These Terms & Conditions (“Terms”) set out the rules for using our Platform and form a binding agreement between you (the “User”) and Car Addicts Cyprus (“the Platform”). By accessing and/or using our website and/or any of our services, you agree to comply with these Terms in full.

1. WHO WE ARE

Car Addicts Cyprus is a community-focused platform based in Nicosia, Cyprus, offering a digital marketplace for private individuals to list, discover, and buy used vehicles through online auctions.

We do not own, have any license or other right of use over, possess, buy, or sell the vehicles listed in the Platform. We are not a dealership, nor do we act as an agent for either Buyers or Sellers. Our role is to provide a secure and transparent online environment for private individuals to transact directly.

2. DEFINITIONS

For the purposes of these Terms:

“Platform” / “Site”The website www.caraddicts.com.cy and any related mobile applications or services.

“User” / “you” / “your” – Any person using our Platform in any capacity whatsoever, including as a Seller, Buyer, or visitor.

“Seller” – A private individual listing a vehicle for auction.

“Buyer” – A private individual placing bids on auction listings.

“Listing” – The details, images, documents, and description of a vehicle offered for auction.

3. ELIGIBILITY

3.1 You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.

3.2 By creating an account, you confirm that:

• All information you provide is accurate, complete, and up to date. You agree to update your information if it changes;
• You are acting on your own behalf and not for any fraudulent or unlawful purpose;
• You are not prohibited from using the Platform under any applicable laws.

3.3 The Platform reserves the right to refuse, suspend, or terminate accounts if eligibility requirements are not met or change.

4. PLATFORM USE

4.1 Role of the Platform

Car Addicts Cyprus provides a platform to facilitate vehicle listings and bidding. We are not a party to any contract between Users, nor do we own, have any license or other right of use over, possess, buy, or sell the vehicles listed on the Platform.

4.2 Prohibited Conduct

You must not:

• Violate any applicable laws or regulations;
• Provide false, misleading, or incomplete information, or impersonate another person or entity;
• Interfere with, disrupt, or attempt to bypass the security or proper functioning of the Platform;
• List vehicles you do not own, or which you are not legally entitled to sell.

4.3 User Responsibility

You are solely responsible for all activity conducted through your account, and for ensuring that any content you post complies with these Terms and applicable laws.

5. VEHICLE LISTING REQUIREMENTS (SELLERS)

5.1 Registration and Listing Request

• To list a vehicle, Sellers must create an account with the Platform and provide identification documents (including ID/Passport copy).
• The Seller must provide details of his/her bank account to which payment of the purchase price will be made after the end of the auction (unless an escrow service is agreed between the Buyer and Seller).
• Sellers must submit accurate vehicle details and recent authentic and unedited photographs through the “Sell with Us” form.

5.2. Reserve Price

• The Seller may specify the reserve price of the vehicle which is the minimum price the Seller is willing to sell the vehicle for. By specifying the reserve price the Seller agrees, that if an auction meets or exceeds the reserve price, the sale is automatically binding on the Seller. The Seller may choose not to set a reserve price, in which case the Seller agrees and is bound to sell the vehicle to the highest bidder irrespective of price.

5.3. Mechanical Inspection

• All vehicles must pass a mechanical inspection at the Platform’s designated mechanic before being listed.
• The Platform’s designated mechanic is an independent service provider and is in not in any way affiliated with or an agent or the Platform.
• Inspection reports will be shared with the Seller and, if the vehicle is listed, with the Buyer, to promote transparency and informed decision-making
• The Seller is responsible at its own costs for transporting the vehicle to and from the inspection location.
• Car Addicts Cyprus will cover the inspection cost.
• The Platform reserves the right at its sole discretion to decline a listing depending on the inspection results including because the vehicle fails inspection or has undisclosed issues.

5.4 Documentation

• Sellers must provide valid proof of ownership and any legally required documents (e.g., MOT/roadworthiness certificate, service history).
• The Seller consents to the publication on the Platform of all documents and information provided by the Seller in connection with the vehicle.

5.5 Accuracy of Information

• Sellers are responsible for ensuring all information provided is complete, accurate, and not misleading. Any misrepresentation or undisclosed information on the vehicle may result in listing cancellation, refusal of future listings, account suspension and/or legal action.

5.6 Listing Exclusivity

Once a vehicle is placed in the “Coming Soon” section:

• The vehicle must be taken off the market and must not be advertised or listed for sale anywhere other than the Platform until the auction has ended.
• The Seller must take all necessary measures to preserve the vehicle’s condition until the auction has ended;
• The Seller must retain possession and ownership and shall not in any way dispose of or grant any right to any person over the vehicle until the auction has ended;
• If the vehicle is not sold at auction, the Seller may choose to keep it listed for two (2) weeks in the “Make an Offer” section for an additional fee.

5.7 Bidding Restrictions

·       Sellers must not bid on their own listing or instruct, encourage, or permit others to place non-genuine bids or bids on the Sellers’ behalf.

5.8 Binding Sale

·       When an auction meets or exceeds the reserve price (if a reserve price is set) or if an auction is completed (if reserve price is not set), the sale is binding. The Seller and Buyer must complete the transaction in accordance with these Terms.

5.9 Optional Services

• The Platform offers optional professional photography for an additional fee.
• The Platform may assist, at the Seller’s request, in arranging professional photographs.
• The Platform does not warrant or verify the accuracy of any photographs, inspection reports, or descriptions created during this process.
• The Seller remains solely responsible for the completeness and accuracy of all listing content.

6. BUYING VEHICLES (BUYERS)

6.1 Registration & Security Deposit

• To place a bid, Buyers must create an account, provide identification documents (including ID/Passport copy) and register a valid payment card with the Platform.
• A €100 refundable security deposit will be pre-authorised on the Buyer’s card before bidding is allowed.
• This deposit will be automatically released after the auction ends if the Buyer is not the highest bidder. If the Buyer is the winning bidder, the deposit will be released within fourteen (14) days of the auction end date unless the Buyer fails to complete the purchase in accordance with the Terms and Conditions in which case the deposit will be forfeited. The deposit funds will become available after the release depending on the Buyer’s Bank’s policies.

6.2 Buyer’s Premium

• The winning Buyer must pay a service fee of 5% on the final auction sale price (hereinafter the “Buyer’s Premium”) directly to Car Addicts Cyprus. Each Buyer, upon submission of a bid for a vehicle, expressly agrees to pay the Buyer’s Premium.
• This Buyer’s Premium is payable immediately by the Buyer upon auction close and is non-refundable.
• Payment of the Buyer’s Premium is separate from the purchase price payable to the Seller.

6.3 Pre-Bidding Responsibilities

Before placing a bid, Buyers must:

• Carefully review all listing details, photographs, inspection reports, and any additional information provided.
• Use the Platform’s messaging or question feature to clarify any uncertainties directly with the Seller before bidding.
• Understand that all bids are legally binding offers to purchase the vehicle. Where there is a set reserve price, all bids are legally binding offers to purchase the vehicle if the reserve price is met or exceeded.

6.4 Winning an Auction

If you are the highest bidder (and where there is a set reserve price, the highest bidder at or above the reserve price) when the auction ends:

• A binding contract is entered into between the you and the Seller for the sale of the vehicle for the final auction sale price.
• You must pay the Buyer’s Premium to the Platform.
• You must pay the final auction sale price directly to the Seller’s designated bank account, or via an escrow service if agreed between the Seller and Buyer.
• Payment and collection of the vehicle must be completed within seven (7) days of the auction end date, unless a different period is agreed in writing by both parties.
• You are responsible for all costs and procedures related to payment of the final auction sale price, vehicle handover, transfer, transport, inspection (if any), insurance, registration, taxes, and duties.

6.5 Failure to Complete a Purchase

If the Buyer fails to complete payment and collection within the required timeframe:

• The Seller may claim against the Buyer for breach of the contract for the sale of the vehicle.
• The €100 security deposit will be forfeited.
• The Buyer may be permanently banned from the Platform.
• The Platform reserves the right to recover any direct costs or losses caused by the Buyer’s non-compliance.

6.6 Buyer Conduct

• Buyers must act in good faith at all times. Placing bids without genuine intent to purchase, or attempting to disrupt an auction, is strictly prohibited and may result in immediate account suspension.

7. FEES & PAYMENTS

7.1 Listing a Vehicle

• Sellers may be charged for optional services such as concierge service, professional photography, or enhanced listing features.
• Unless otherwise stated during the onboarding process, there are no standard listing fees.

7.2 Buyer’s Premium

• The winning Buyer must pay the Buyer’s Premium directly to Car Addicts Cyprus.
• Minimum and maximum fee amounts may apply.
• The applicable Buyer’s Premium will be clearly displayed before bidding.
• The Buyer’s Premium is non-refundable.

7.3 Payments Between Buyer and Seller

• All payments for the vehicle purchase price are made directly between Buyer and Seller via payments to the Seller’s designated bank account, unless an escrow service is arranged by the Platform.
• The Platform will not be responsible for any losses resulting from private payment arrangements.

8. DISPUTES & LIMITATION OF LIABILITY

8.1 No Responsibility for Vehicle Condition or Ownership
Car Addicts Cyprus is not responsible for the condition, legality, history, or ownership status of any vehicle listed on the Platform, for which the Seller is fully responsible and liable for.

8.2 Dispute Resolution

Any disputes arising from a transaction must be resolved directly between the Buyer and the Seller. The Platform is not a party to any sale contract and will not mediate or arbitrate disputes unless expressly agreed in writing.

• At its sole discretion, the Platform may offer informal assistance to help the parties communicate and attempt to resolve a dispute.
• Such assistance is provided as a courtesy only, and the Platform accepts no responsibility for the outcome or for enforcing any agreement reached between the parties.

8.3 Honest Presentation & No Guarantee
The vehicle information is presented on the Platform exclusively based on the information listed and/or provided by the Seller and the mechanical inspection report issued by the independent mechanic. The Platform acts solely as a platform to facilitate auctions and sales between Buyers and Sellers, and does not assume or accept any responsibility or liability for the vehicle information (including the mechanical inspection report), or for any loss, damage, or claim arising from reliance on such information. Buyers are solely responsible for conducting their own due diligence, inspections, and investigations before bidding for or purchasing a vehicle. Therefore:

• The Platform does not verify, and makes no representation, warranty, or guarantee (express or implied) as to the accuracy, completeness, reliability, or suitability of any vehicle information presented in the Platform. The Platform does not inspect or certify the condition, quality, safety, roadworthiness, or legality of any vehicle listed
• The Platform does not guarantee that any listing is free from errors or omissions.
• The Platform is not responsible for any hidden, latent, or undisclosed defects or issues of the vehicle.
• The Platform does not verify or guarantee the accuracy of third-party mechanic reports, photographs, or Seller-provided information. Such services are provided for convenience only, and reliance on them is at the user’s own risk.
• Participation in an auction or transaction through the Platform shall be deemed acknowledgment and acceptance of this disclaimer.

• Limitation of Liability
  
  

• To the fullest extent permitted by law, the Platform, its owners, directors, officers, employees, contractors, and affiliates shall not be liable for any loss, damage, cost, expense, claim, or liability of any kind (whether direct, indirect, incidental, consequential, special, exemplary, or punitive) arising out of or in connection with:

• The non-completion of the sale and purchase of the vehicle (including due to non-payment or non-delivery);
• any vehicle information published on the Platform, including but not limited to inaccuracies, errors, omissions, misrepresentations, or misleading statements;
• the condition, quality, safety, roadworthiness, legality, or suitability of any vehicle listed for sale;
• any transaction, negotiation, communication, or arrangement between Buyers and Sellers, including any failure to complete a sale, delay, cancellation, or dispute;
• any fraud, misrepresentation, or misconduct by any Platform user;
• any technical failure, interruption, downtime, error, omission, or loss of access to the Platform; and
• any use of, or reliance upon, the Platform or its contents by any user.

• The Platform, its owners, directors, officers, employees, contractors, and affiliates shall not in any circumstances be liable to any user or third party for:

• loss of profits, revenue, opportunity, business, goodwill, or anticipated savings;
• loss or corruption of data; or
• any indirect, consequential, or special damages, even if the possibility of such losses could reasonably have been foreseen.

• Nothing in these Terms shall exclude or limit liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

8.5 Platform Availability & Warranties
The Platform is provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied. The Platform does not guarantee uninterrupted access, error-free operation, or the absence of defects, viruses, or harmful components.

9. PRIVACY & DATA

9.1 Privacy Policy

The Platform collects, stores, and processes personal information in accordance with its [Privacy Policy], which forms part of these Terms & Conditions. By using the Platform, you consent to such collection and processing.

9.2 Payment Processing

The Platform uses reputable third-party service providers (e.g., Stripe) for secure payment processing. The Platform does not store or have access to full payment card details. All payment information is handled in accordance with the provider’s own privacy and security policies.

9.3 Data Protection & Misuse

Users must not collect, copy, scrape, harvest, or otherwise misuse any data from the Platform, including other users’ personal information, vehicle details, or photographs. Any breach of this provision may result in account suspension, legal action, and/or reporting to relevant authorities.

9.4 International Data Transfers
Where your personal data is transferred to and processed in countries outside the European Economic Area (EEA), the Platform will ensure that appropriate safeguards are in place, such as Standard Contractual Clauses or other lawful transfer mechanisms, in compliance with applicable data protection laws.

10. INTELLECTUAL PROPERTY

10.1 Ownership
All content, trademarks, logos, graphics, text, software, photographs, videos, and other materials on the Platform are the property of Car Addicts Cyprus or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws.

10.2 Restrictions on Use
Users may not copy, reproduce, modify, distribute, display, transmit, or otherwise use any content from the Platform without the prior written consent of Car Addicts Cyprus, except where permitted by law.

10.3 User-Provided Content

By uploading, submitting, or posting any images, text, or other content to the Platform, you:

• Warrant that you own or have the right to use such content; and
• Grant Car Addicts Cyprus a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, display, distribute, and promote that content for the purpose of operating the Platform, promoting your listing, and marketing our services.

10.4 Retention of Rights
Nothing in these Terms & Conditions grants you any rights or licences to use the trademarks, logos, or other intellectual property of Car Addicts Cyprus without prior written consent.

11. TERMINATION

11.1 Suspension or Termination by the Platform
The Platform may suspend or permanently terminate your account and/or access to the Platform at any time, without prior notice, if:

• You violate these Terms & Conditions or any applicable law;
• You list, upload, or share misleading, false, or illegal content;
• You engage in fraudulent, abusive, or disruptive behaviour;
• Your actions are deemed harmful to the integrity, reputation, or security of the Platform.

11.2 Termination by the User
You may close your account at any time by sending a written request to info@caraddicts.com.cy.

11.3 Effect of Termination
Upon termination for any reason:

• Your right to access and use the Platform will cease immediately.
• Any outstanding fees, charges, or contractual obligations will remain payable.
• The Platform may retain and use any content or data you have provided to the extent permitted by law.
• If your account is terminated due to a violation of these Terms, you will not be entitled to any refund of fees or charges already paid.

12. CHANGES TO TERMS

12.1 Updates

The Platform may amend or update these Terms & Conditions from time to time. Material changes will be communicated to users via email, account notifications, or a notice on the Platform.

12.2 Acceptance of Changes

Continued access to or use of the Platform after any changes take effect will constitute your acceptance of the updated Terms & Conditions. If you do not agree to the changes, you must stop using the Platform immediately.

12.3 Archived Versions

The Platform will maintain an archive of previous versions of these Terms & Conditions, which will be available upon request for reference and transparency purposes.

13. GOVERNING LAW

These Terms & Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of Cyprus. The courts of the Republic of Cyprus shall have exclusive jurisdiction to settle any such dispute or claim.
